Reduction to Notary & Land Registry fees

A rule was recently issued in Spain in which Notaries and Registrars are forced to amend their fees and adapt them to previous regulation on public services. Notaries are forced to review and reduce their fees by approximately 5 %. The Land Registry fees will be reduced by approximately the same amount.

New Wealth Tax

Recently, the Spanish authorities have  introduced a new wealth tax in Spain, seeking ways to generate additional tax revenue. This wealth tax has been introduced by Royal Decree from September 2011, which will stay in place for at least two years. The tax will affect individuals with assets valued at €700,000 or above.  The tax liability in most cases will amount to around 2% of the value of the assets. Each individual will need to submit an annual self assessment tax return. The authorities are able to impose fines of up  €1,000 for late submission or non appointment of a tax representative.

Taxes when renting out your property

If a non-resident is renting a property and receives an income, the non-resident is obliged by law to declare this income and pay taxes. Non-residents pay a flat rate of 25% of the gross income they earn from their property in Spain.

Capital Gains Tax Exemptions

Capital Gains Tax is the tax to be paid by a non-resident owner, when selling his property. The tax amount is 18%, with a 3% withholding provision.

Exemptions from Spanish Capital Gains Tax?
Residents over 65 yrs old, selling their principal residence in which they have lived for the past three years are not liable for capital gains tax in Spain.
